Welcome to CareerPathway.com. These Terms of Use ("Terms") are a binding agreement between you and In It For The Trades, LLC, a Nebraska limited liability company doing business as CareerPathway.com ("CareerPathway.com," "we," "us," or "our").
These Terms govern your access to and use of:
By visiting the Website, creating an account, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.
We may revise these Terms at any time. Changes take effect when posted, and the "Last Updated" date above will change. If we make a material change, we will take reasonable steps to notify account holders, such as by email or an in-Platform notice. Your continued use of the Services after a change takes effect means you accept the revised Terms. Changes to Section 19 (Governing Law and Disputes) do not apply to any dispute of which the parties had actual notice on or before the date the change was posted.
Minimum age. The Services are available to individuals 13 years of age or older. Individuals under 13 may not use the Services, create an account, or submit any information to us under any circumstances.
Users aged 13 to 17. An individual who is at least 13 but under 18 (a "Permitted Minor") may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms on the Permitted Minor's behalf. By creating an account as a Permitted Minor, you represent that you have obtained that permission. A parent or guardian who permits a Permitted Minor to use the Services is responsible for that minor's use of the Services, including any charges incurred and any content the minor submits.
Adults. By using the Services, you represent and warrant that you are of legal age and capacity to enter into a binding contract, that all registration information you submit is accurate and current, and that your use of the Services complies with these Terms and applicable law.
Parents and guardians. If you believe a Permitted Minor has created an account without your permission, or you want that account closed, contact us at support@careerpathway.com and we will act on your request.
Access is gated. Features beyond our public marketing pages require an account. Account creation and sign-in are handled through Amazon Cognito, and a verification code is sent to the email address you provide. You must verify that email address before you can access the Platform.
Profile types. CareerPathway.com issues different profile types with different features and visibility:
Student — Individuals aged 13 to 17
Professional — Individuals aged 18 and over
Educators & Mentors — Teachers, counselors, advisors, and mentoring organizations
Businesses & Organizations — Employers, associations, agencies, and other organizations
Colleges & Universities — Post-secondary institutions and training providers
Your profile type is assigned based on the information you provide when you register, including your age. Providing false information to obtain a profile type you are not eligible for is a material breach of these Terms. If we determine that an account holder has misstated their age or eligibility, we may suspend or close the account.
Student profiles are private by default. A Student profile is not visible to other users unless the student changes that setting themselves in their profile settings. Even when a student chooses to make a profile viewable, it remains a limited version of a profile.
Student accounts are deliberately limited. Student accounts cannot add a profile picture or any other image, cannot create posts, and cannot comment on posts. Students may communicate only through the pre-written message options in the Platform inbox. These limits exist to protect minors, and we may change them as we improve the Platform.
Moving from Student to Professional. A Student profile does not upgrade automatically when the account holder turns 18. To request an upgrade, contact support@careerpathway.com; we will verify the request by email before changing the profile. We strongly recommend registering with a personal email address rather than a school-issued address, so that you keep access to your account after you leave school.
Account security. You are responsible for keeping your credentials confidential, for all activity under your account, and for notifying us promptly at support@careerpathway.com of any unauthorized use. Accounts are personal to the account holder and may not be shared, sold, or transferred. We may disable any credential at any time if we reasonably believe these Terms have been violated.
CareerPathway.com is a platform that helps individuals explore careers and helps organizations make opportunities visible. We are not an employer, a staffing agency, an educational institution, a licensed career counselor, or a party to any relationship that forms between users.
You acknowledge that:
"User Content" means anything you submit, post, or upload through the Services, including profile information, text, images, logos, opportunity listings, messages, resumes, and assessment responses.
You keep ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting and display, publish, and distribute your User Content solely to operate, provide, secure, and improve the Services. This license lasts as long as your User Content is on the Services and for a reasonable period afterward for backup and legal-compliance purposes.
You are responsible for your User Content. You represent that you own or have the rights to submit it, that it is accurate, and that it does not violate these Terms, any law, or anyone else's rights.
Content involving minors. Do not post images, contact details, academic records, or other personal information about a minor unless you are that minor, or that minor's parent or guardian, and you have the right to do so.
We may remove content. We may review, refuse, edit, or remove any User Content at any time, with or without notice, if we believe it violates these Terms or creates risk for us or our users. We are not obligated to monitor User Content, and we are not responsible for User Content submitted by others.
Feedback. If you send us suggestions or feedback about the Services, you grant us an unrestricted right to use it without obligation to you.
This section applies to organizations with a profile on CareerPathway.com. It is new, and it replaces any prior understanding on this subject.
If you create or maintain a profile for a business, association, agency, educational institution, or other organization, you grant CareerPathway.com a non-exclusive, worldwide, royalty-free, revocable license to use that organization's name, trade name, and logo for the limited purpose of:

You represent that the person accepting these Terms on the organization's behalf is authorized to grant this license.
Our marks. "CareerPathway.com" and our logo are our trademarks. You may not use them without our prior written permission, except that you may state factually that your organization participates on CareerPathway.com. All other names, logos, and marks appearing on the Services belong to their respective owners, and no license to them is granted by these Terms except as described in this Section 6.
The Services and their contents, features, and functionality — including text, designs, graphics, images, video, audio, software, and the selection and arrangement of all of it — are owned by us, our licensors, or other providers, and are protected by United States and international intellectual property laws.
We grant you a limited, revocable, non-transferable license to access and use the Services for their intended purpose:
You may view, download, and print a reasonable number of pages for your own use and for the intended purpose of the Services. You may not otherwise copy, reproduce, republish, sell, license, distribute, modify, create derivative works from, publicly display, or exploit any part of the Services. You may not remove any copyright or proprietary notice. All rights not expressly granted are reserved.
Some profile types and features are offered on paid plans. Student and Professional profiles for individuals are free.

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
Enforcement. We may investigate suspected violations, remove content, suspend or terminate accounts, and cooperate with law enforcement. We may disclose your identity to a third party who claims your use violates their rights, and we may take action, including contacting appropriate authorities, if we believe a user may be at risk of harm. Violations of system or network security may result in civil or criminal liability.
If you encounter content or conduct that concerns you — particularly anything involving the safety of a minor — report it to support@careerpathway.com. We take reports seriously and will respond as promptly as we reasonably can.
We do not sell advertising space. We do not display third-party advertisements on the Website or in the Platform, and we do not allow third parties to market to our users through the Services.
Leader Sponsors. Some organizations pay for a sponsored position, shown as a Leader Sponsor, so that their profile or opportunity appears in a prominent placement. A Leader Sponsor placement is a paid position; it is not an endorsement by CareerPathway.com and it does not mean we have vetted or recommend that organization. We label these placements so that it is clear they are sponsored.
We do not market to minors. We do not send marketing communications to Student accounts, we do not build advertising audiences from Student accounts, and we do not run advertising or analytics trackers on the pages built for students. Our own advertising, on platforms such as Meta and LinkedIn, is targeted to adults.
The Services may link to or integrate third-party websites, resources, assessments, and services. We provide them for convenience and we do not control, endorse, or take responsibility for them. Your use of a third-party service is governed by that party's terms and privacy policy, and is at your own risk.
You may link to our public pages in a way that is fair and lawful, that does not damage our reputation, and that does not suggest association, approval, or endorsement by us without our written consent. You may not frame the Services or use in-line linking to present our content as your own. We may withdraw linking permission at any time.
We want the Services to be usable by everyone. If you encounter a barrier to access, please tell us at support@careerpathway.com and we will work with you to provide the information or functionality you need.
You may close your account at any time by contacting support@careerpathway.com. See our Privacy Policy for what happens to your information when you do.
We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if you breach these Terms, if we believe your use creates risk or legal exposure for us or another user, or if we discontinue the Services. Sections that by their nature should survive termination will survive, including Sections 5, 6, 7, 15, 16, 17, and 18.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that any content or information available on or through the Services is accurate, complete, or current. Any reliance you place on information posted on the Services is at your own risk.
You are responsible for maintaining your own anti-virus protection and for keeping copies of anything important to you. We will not be liable for loss or damage caused by a denial-of-service attack, virus, or other technologically harmful material that may infect your equipment or data because of your use of the Services.
Nothing in these Terms excludes or limits any warranty or liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, neither CareerPathway.com nor its members, managers, officers, employees, contractors, agents, licensors, or service providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising out of or relating to your use of, or inability to use, the Services — whether based in contract, tort, statute, or otherwise, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless CareerPathway.com and its members, managers, officers, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your use of the Services.
These Terms and any dispute arising out of or relating to them or to the Services are governed by the laws of the State of Nebraska, without regard to its conflict-of-law rules. Any legal action must be brought exclusively in the federal or state courts located in Lincoln, Lancaster County, Nebraska, and you consent to the jurisdiction and venue of those courts. We retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.
Time limit. Any claim arising out of or relating to these Terms or the Services must be commenced within one (1) year after the cause of action accrues, or it is permanently barred.
We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).
A DMCA notice must include: your physical or electronic signature; identification of the copyrighted work you believe was infringed; identification of the material you believe is infringing, described precisely enough for us to locate it; your name, postal address, telephone number, and email address; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; a statement that the information in the notice is accurate; and a statement, under penalty of perjury, that you are authorized to act on the copyright owner's behalf.
If you believe your material was removed by mistake, you may submit a counter notice containing: your signature; identification of the removed material and where it appeared; your contact information; a statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification; and a statement consenting to the jurisdiction of the federal district court for the district where you live (or, if you live outside the United States, any district where we may be found) and accepting service from the party who filed the notice.

Notices that do not meet the DMCA's requirements may not be effective. If you knowingly misrepresent that material is infringing, or that it was removed by mistake, you may be liable for damages under 17 U.S.C. § 512(f). We may restore removed content if the original complainant does not file a court action within ten business days of receiving a counter notice. We may terminate the accounts of repeat infringers.
Entire agreement. These Terms, our Privacy Policy, and any order form or invoice between us are the entire agreement between you and us regarding the Services and supersede all prior understandings on that subject.
Severability. If any provision is held invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
